What is the purpose of the privacy policy?

The purpose of this Privacy Policy is to inform you about the means that CIAUDANO implements to collect and process your personal data, which you are required to provide to CIAUDANO through the use of our Site www.ciaudanoshop.com, with the strictest respect for your rights.

What is the GDPR?

Regulation (EU) 2016/679 of the European Parliament and of the Council of April 27, 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95 / 46 / EC (hereinafter “General Data Protection Regulation” or “GDPR”) aims to harmonize the laws concerning data protection within the European Union and to increase data protection personal.

1. Definitions

Buyer: refers to any natural person who places or has placed an order on the CIAUDANO Site.

CIAUDANO: refers to the company CARLA CIAUDANO & CIE, Société en Commandite Simple whose head office is located at 18 Boulevard des Moulins in MONACO (98000), registered in the Monaco Trade and Industry Directory under number 95S03129.

Account: refers to the “My account” part on the Site and allowing any natural person to access a personalized space summarizing the following information: personal data, delivery and billing addresses, order history, follow-up of order returns, membership of the CIAUDANO loyalty program, subscription to the newsletter.

Personal data: refers to all data that makes it possible to identify an individual directly or indirectly, by aggregating several data which corresponds in particular to your name, first name (s), pseudonym, e-mail address, number (s) of telephone number, date of birth, data relating to your transactions on the Site, as well as any other information that CIAUDANO may ask you and that you choose to communicate to us about yourself.

Products: refers to all the Products offered for sale on the Site.

Prospect: refers to any natural person who is not yet a Buyer on the Site but who may become.

Site: refers to the Website, edited by CIAUDANO, accessible at the address www.ciaudanoshop.com.

2. Who is the data controller for your personal data?

Being the owner and manager of the CIAUDANO Site assumes almost all of the commitments made to ensure the respect and protection of your privacy.

3. What data does CIAUDANO collect?

3.1 Data that you transmit directly, and in particular:

  • The data required to create your Account on our Site: Title, Last Name, First Name, email address, date of birth
  • A telephone number which is requested from you when you wish to place an order for the first time by choosing Colissimo or Chronopost as a delivery method.
  • A copy of all orders made on our Site
  • Details of financial or accounting operations carried out on our Site
  • The history of your visits to our Site and the content you have accessed
  • Data that CIAUDANO requests by email when you report a problem with our Site or our services, such as the subject of your request

3.2 Data that CIAUDANO collects automatically:

We record usage and navigation data when you access our Site

During each of your visits, CIAUDANO may collect, in accordance with the applicable legislation and with your agreement, where applicable, information relating to the devices on which you use our Site or to the networks from which you access our Site, such as that in particular your IP addresses, plugins of your browser, operating systems and platforms, data concerning your navigation path on our Site, in particular your journey on the various URL pages of our Site, the content that you access or that you consult.

4. How long does CIAUDANO keep your data?

4.1 With regard to data relating to the management of our commercial relationship with Buyers and Prospects:

Your personal data will not be kept beyond the period strictly necessary for the management of our commercial relationship with you; however, the data allowing to establish the proof of a right or a contract, or kept for the respect of a legal obligation, can be the object of an intermediate archiving policy for a period not exceeding the time necessary for the purposes for which they are kept, in accordance with the provisions in force.

Regarding possible prospecting operations, your data may be kept for a period of three (3) years from the end of the commercial relationship. At the end of this three (3) year period, we will be able to contact you again to find out if you wish to continue to receive commercial solicitations. In the absence of a positive and explicit response from the person, your data will be deleted or archived in accordance with the provisions in force for reasons that are strictly limited and authorized by law (payment, guarantee, disputes, etc.).

Likewise, personal data relating to a Prospect, who is not a client, may be kept for a period of three (3) years from their collection by the controller or from the last contact from the Prospect.

4.2 With regard to audience measurement statistics:

The information stored in the users’ terminal or any other element used to identify users and allowing their traceability or attendance will not be kept beyond thirteen (13) months.

4.3 With regard to other financial data:

For example, payments, refunds, etc., are kept for the period required by applicable tax and accounting laws.

5. Why does CIAUDANO collect your personal data?

During the purchasing process, CIAUDANO implements the processing of personal data in order to enable it to manage, bill, ship and monitor orders placed on the Site.

We may also use this data to send you informational and/or prospecting emails if the Buyer or the Prospect has previously given permission by subscribing to our newsletter.

We inform you, when collecting your personal data, whether certain data must be entered or if they are optional. We also tell you what the possible consequences of a failure to respond.

6. Who will be the beneficiaries of your personal data?

Your personal data are only transmitted to our service providers and contractual partners, as subcontractors within the meaning of the GDPR, for the purpose of ensuring good order management and the monitoring of the resulting commercial relationship, in particular:

  • To our payment service provider to offer you the remote payment of our products by credit card.
  • To our relay point provider in order to offer you a delivery service to the Point Relais of your choice.
  • To our service providers intervening for the needs of our marketing and web marketing communication with your consent.

Subcontractors can only act on instructions from CIAUDANO.

7. What are your rights to the data?

In accordance with the GDPR, the following rights are recognized regarding the processing of your personal data:

  • Right of access: You have the right to verify that your personal data is being processed, and where applicable, to obtain a copy of this data and full information about the processing.
  • Right of rectification: You have the right to correct errors, modify inaccurate or incomplete data and verify that the data processed is correct.
  • Right of deletion: You have the right to delete your data as soon as possible if the processing is illegal or the purpose of the processing or collection has disappeared.
  • Right to restriction: You have the right to request the suspension of processing if it is illegal or inappropriate.
  • Right to object: You have the right to object to the processing of your personal data if the purpose of the processing is direct marketing or the processing is to be discontinued for reasons relating to your personal situation, unless we can demonstrate compelling and legitimate reasons to continue their processing or if the processing is necessary to exercise or defend a right.
