Delivery

Items purchased on the Site by the Buyer are shipped to the delivery address indicated on the Site by the Buyer when ordering.

At the time of shipment of the latter, the Seller sends by email to the Buyer the tracking number of his package, as well as the invoice for his order and the date of validation of his order.

In-store withdrawals may be offered free of charge at some locations. The Seller will inform the Buyer by e-mail or telephone when the product is ready to be collected in the store.

I.1 Delivery Times

CIAUDANO will use reasonable efforts to ensure that delivery is made by the carrier within the estimated delivery times from the date of the Written Order and Shipping Confirmation, and in any event within thirty (30) days following that date, except for the purchase and delivery of custom-made items or items that must be personalized at the request of customers. For these items the Seller will provide the Buyer with specific shipping times, proportional to the labor time required for the production or customization of the Items.

If by extraordinary circumstances (interruption of internet or postal services, server breakdown, etc.) the shipment could not take place within the agreed time limits, the Seller will notify the Buyer and indicate a new shipping time.

In order for these deadlines to be respected, the customer must ensure that they have communicated exact and complete information concerning the delivery address (such as, in particular: street, building, staircase number, access codes names and/or intercom numbers, etc.). Inaccurate information may indeed lead to additional delivery delays, or even reshipment. In the event that the customer would have to refuse delivery of his package, the shipping costs cannot be reimbursed.

Outside the European Union, it is reminded that delivery may be delayed until the formalities and customs costs have been paid by the Buyer, which he accepts. The refusal of payment by the Purchaser of customs fees entails the cancellation of the order and its reimbursement. Any freight and customs clearance costs paid to recall the order will be deducted from the refunded amount.

In all cases, in the event of non-receipt of a parcel within the prescribed time limits, the Buyer may contact the Seller by telephone, at number +377 93 50 52 00 or by sending an e-mail to the following address: montecarlo@ciaudano.com

I.2 Transfer of Ownership

The transfer of ownership of items offered for sale on the Site for the benefit of the Purchaser will only be carried out after full payment of the price by the latter, regardless of the delivery date of said items.

I.3 Fees

CIAUDANO reserves the right to modify the delivery costs at any time, in particular in the event of modification of the costs of the carriers. The delivery costs are indicated to the customer before he validates an order.

These prices are subject to variations. When the Buyer requests to be delivered by express carrier the shipping costs will vary depending on the destination and will be added to the price of the Items.

I.4 Customs Duties

Any order placed on the Site or the Platforms may be subject to possible taxes and customs duties which may be levied in the countries where the Items are delivered. These customs duties and any taxes related to the delivery of an item are the responsibility of the Buyers and are their responsibility. The Seller is not required to verify and inform the Buyers or Users of the applicable customs duties and taxes. To find out about them, Buyers should check with the competent authorities in their country.

I.5 Place of Delivery

Delivery of the Articles by the carrier will be made to the address indicated by the Buyer. In the event of the Buyer's absence at the place of delivery, duly noted by the carrier alone, and depending on the transport methods chosen by the Buyer, the carrier will leave a transit advice note in the letterbox with either a telephone number of the service to contact to arrange a second delivery, indicating the need to go to one of the carrier's offices to collect the item. The costs of the new delivery will be borne by the Customer.

CIAUDANO reserves the right to refuse to deliver orders from individuals to collective addresses such as offices, hotels, or healthcare establishments. In the event of delivery to a collective address, the customer acknowledges that CIAUDANO's obligation to send the Articles will be deemed fulfilled as soon as the Articles are delivered to the collective address indicated in the order form, that the shipment either received by the final recipient or by a third party.

If the Purchaser has indicated a recipient other than himself for the delivery (for example if it is a gift), the Purchaser understands and accepts that a signature of said recipient (or of a person to the delivery address) constitutes proof of delivery and payment of the sales contract by CIAUDANO, implying a transfer of responsibility to the recipient's address, as if the product had been delivered to you. For certain categories of products, CIAUDANO reserves the right to deliver the products only to the person who is the intended recipient of the order as indicated on the label of the package, and to request an identity check for verification purposes time of delivery.

I.6 Non-compliant Deliveries

Despite the care taken in preparing our orders, some items in an order may be missing or not conforming to the descriptions. This is why upon receipt of his order, the Buyer will ensure the conformity of the items received and must refuse any package opened, torn and/or re-packaged by the carrier.

Any anomaly concerning the delivery (missing, defective, non-compliant or damaged package) must be notified within three (3) days of receipt of the package by the Buyer to the Seller whose address is: 18 Boulevard des Moulins, 98000 MONACO or by e-mail to the following address: montecarlo@ciaudano.com

Any complaint formulated after this deadline will be rejected CIAUDANO will be released from any responsibility.

If the aforementioned conditions are met, and, independently of the exercise of the right of withdrawal provided for in Article VIII of the General Conditions, CIAUDANO will then proceed either to the refund of one or more defective Items or to the reshipment of the missing Item or damaged subject to the validity of the Buyer's request and the availability of the item in question. CIAUDANO reserves the right to ask the Purchaser at its expense to return the non-compliant or defective Item to it.

The refund is made within a maximum period of fourteen working days from the date of receipt by CIAUDANO of the parcel forwarded by the Buyer.

Right of Withdrawal

II.1 Right of Cancellation

In accordance with article 10 of Law no. 1.383 of 02/08/2011 on the Digital Economy published in the Official Journal of the Principality of Monaco of 12 August 2011, the Buyer has a withdrawal period of 7 clear days to exercise his right of withdrawal and return to CIAUDANO Items without having to justify reasons or pay penalties. This period runs from the day of receipt of the Articles by the Buyer. It is increased to 14 clear days in the event of delivery on the territory of the European Union.

The Buyer who wishes to exercise his right of withdrawal must notify the Seller of his decision to release himself from his commitments by means of an unambiguous declaration sent by post or electronic mail and return at his expense the Items which do not give him satisfaction at the following address: CIAUDANO, 18 Boulevard des Moulins, MONACO (98000).

The Purchaser may, if he wishes, use the model withdrawal form below (Annex 1). Returned Items must imperatively be accompanied by the sales invoice which will have been sent to the Buyer with the Item.

CIAUDANO will verify that the returned product meets the cancellation and return conditions. If this is the case, CIAUDANO will proceed with the applicable refund.

The right of withdrawal does not apply to Articles made to measure as well as to those personalized or "customized" according to the Buyer's specifications.

Thus, orders for personalized products cannot be canceled and personalized products cannot be returned to the Seller for an exchange or a refund.

II.2 Return Process and Conditions

II.2.a) Conditions for Returning Products

The Buyer undertakes to return the product to CIAUDANO at the CIAUDANO store located at the following address: 18 boulevard de Moulins 98000 MONACO.

The Customer can return the product directly to the CIAUDANO Boutique or follow the steps mentioned below:

  • Contact the CIAUDANO Boutique in Monaco at n° +377 93 50 52 00 in order to:
    • Agree on a withdrawal date with CIAUDANO's logistics partner;
    • Fill out the return form which will be sent to you by email;
    • Include in the packaging the return form completed with the product as well as all of its accessories, the free items you received as part of your order, the Warranty document and all other documents, in their box of origin;
    • Give the package to CIAUDANO's logistics partner on the agreed date and collect the waybill in exchange from the logistics partner

The Customer must keep proof of the return shipment, CIAUDANO declines all responsibility in the event that the Customer is unable to provide said proof. Only goods received at the CIAUDANO Boutique located at 18 boulevard de Moulins 98000 MONACO will be eligible for a refund.

Our products must be returned in new and undamaged condition, in perfect condition, with all protective materials in place and accompanied by exactly the same number of links as in the original packaging and the labels and stickers affixed thereto (if applicable), as well as the original box and packaging, including all accessories and documents.

CIAUDANO reserves the right not to accept any return if the product shows signs of wear, or has been used or altered from its original condition in any way or, we can reduce the amount of any refund.

If you received free items as part of your order, they must be returned with the products.

All returns will be subjected by CIAUDANO to a rigorous Quality Control ("QC") in order to ensure that the returned products comply with these quality requirements. If the products do not meet QC standards, CIAUDANO will refuse the return, and the products will be returned to the Buyer. If the returned product meets QC, we will issue a refund.

Failure to comply with these Conditions of Sale will give CIAUDANO the right to refuse the returned product and return it to the Buyer at the latter's expense.

II.2.b) Non-exchangeable and Non-refundable Products

Orders for products that have been personalized for you cannot be canceled and such products cannot be returned to us for an exchange or a refund. These include products that have been engraved, embossed or altered in their size or measurement.

Writing instruments that have been filled with ink, as well as bottles and refills that have been opened, cannot be returned to us.

II.2.c) Refunds

The buyer may return a product purchased on the Site for a refund, provided that the return complies with these Terms of Sale, in particular (a) the Right of Cancellation and (b) the Return Process above.

Only the buyer will be entitled to receive a refund of the purchase price. A person who received the product as a gift (namely the "Recipient of a Gift") will in no case be entitled to receive a refund.

If the return complies with these Conditions of Sale, CIAUDANO will use reasonable efforts to reimburse the purchase price of the product to the buyer using the same means of payment that it used to settle the initial transaction within fourteen (14) days of receipt of the returned product.

Delivery costs will not be reimbursed and the costs of returning the product (namely the costs of the logistics partner CIAUDANO) will remain the responsibility of the Purchaser ("Customer").
